Who is Eligible for Services?To be eligible for special education and related services, a child must meet IDEA’s definition of "a child with a disability' (see below). [Section 300.8] Who is a "Child with a Disability?"According to IDEA, a “child with a disability” is a child who has one (or more) of the disabilities listed below and who, because of that disability, needs special education and related services. IDEA’s Categories of Disability:
Special RuleUnder IDEA, if a child has a lack of instruction in math or reading, or has limited English proficiency, he or she must not be identified as being a “child with a disability,” if any one of those is the reason for determining the child has a disability.
