Determining Eligibility

Who Decides if a Child is Eligible for Services?

A team of qualified professionals, and the parents of the child. [Section 300.306(a)(1)]

 

Who is Eligible for Services?

To be eligible for special education and related services, a child must meet IDEA’s definition of "a child with a disability' (see below). [Section 300.8]

Who is a "Child with a Disability?"

According to IDEA, a “child with a disability” is a child who has one (or more) of the disabilities listed below and who, because of that disability, needs special education and related services.

IDEA’s Categories of Disability:

  • mental retardation
  • hearing impairments (including deafness)
  • speech or language impairments
  • visual impairments (including blindness)
  • emotional disturbance
  • orthopedic impairments
  • autism
  • traumatic brain injury
  • other health impairments
  • specific learning disabilities

Special Rule

Under IDEA, if a child has a lack of instruction in math or reading, or has limited English proficiency, he or she must not be identified as being a “child with a disability,” if any one of those is the reason for determining the child has a disability. [Section 300.306(b)]
